These Terms and Conditions (“Terms”) govern your access to and use of our Website and services (“Services”). By accessing or using our Services, you agree to be bound by these Terms.

By accessing or using our Services, you confirm that you accept these Terms and agree to comply with them, as well as our Privacy Policy.

2. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to use our Services. By using our Services, you represent and warrant that you meet this age requirement.

3. Description of Services

doloc provides an API-based translation service that allows users to:

  • Send translation files (e.g., XLIFF 1.2/2.0 files) via API or curl command.
  • Receive instant translations of the source texts in the files.
  • Integrate the translation process into their development workflow.
  • Utilize features such as instant translation, consistent style without a dictionary, and easy integration.

4. Account Registration and Security

Registration: To access certain features of our Services, you need to register for an account. You agree to provide accurate, current, and complete information during the registration process and to keep your account information updated.

Account Security: You are responsible for safeguarding your account credentials (including created api tokens). You agree not to disclose your password and api tokens to any third party and to notify us immediately of any unauthorized use of your account.

5. User Obligations

By using our Services, you agree to:

  • Use the Services in compliance with all applicable laws and regulations.
  • Provide accurate information and update it as necessary.
  • Be responsible for all activities that occur under your account.
  • Use the Services solely for your internal business purposes or personal use.

6. Prohibited Uses

You agree not to:

  • Use the Services for any unlawful or unauthorized purpose.
  • Upload or transmit any content that is illegal, harmful, threatening, defamatory, obscene, or otherwise objectionable.
  • Interfere with or disrupt the integrity or performance of the Services.
  • Reverse engineer, decompile, or disassemble any aspect of the Services.
  • Circumvent any limitations or restrictions on your account.
  • Resell or sublicense the Services to any third party, without our prior written consent.

7. Pricing and Payment

Plans and Pricing: We offer Free, Hobby, and Pro plans with specific features and limitations as outlined on our Pricing page.

Payment Terms: For paid plans, fees are billed monthly in advance. By selecting a paid plan, you agree to pay the applicable fees and taxes. Prices are in Euros (€) and exclude VAT.

Trial Period: Paid plans come with a 14-day trial period. If you cancel before the trial period ends, you will not be charged.

Changes to Pricing: We reserve the right to change our pricing at any time. Any changes will be effective at the start of your next billing cycle after we provide notice.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns

8. Refund Policy

We offer a 30-day money-back guarantee for all paid plans. If you are not satisfied with our Services, you may request a refund within 30 days of your initial purchase.

Refunds will be processed within a reasonable time after approval.

9. Intellectual Property Rights

Ownership: All intellectual property rights in the Services and Website content are owned by doloc or our licensors.

License: We grant you a limited, non-exclusive, non-transferable license to access and use the Services for your personal or internal business purposes.

Restrictions: You may not reproduce, distribute, modify, or create derivative works of any content provided through the Services without our prior written consent.

10. Disclaimer of Warranties

The Services are provided on an “AS IS” and “AS AVAILABLE” basis.

We do not warrant that the Services will be uninterrupted, error-free, or free from viruses or other harmful components.

We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the fullest extent permitted by law, in no event shall doloc, its affiliates, or their respective directors, officers, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services.

Our total liability to you for any damages shall not exceed the amount you have paid to us in the last six (6) months, or one hundred Euros (€100), whichever is greater.

12. Indemnification

You agree to indemnify, defend, and hold harmless doloc, its affiliates, and their respective directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your infringement of any intellectual property or other rights of any third party.

13. Modifications to the Terms

We may modify these Terms at any time. If we make material changes, we will provide notice through our Services, by email or by other means. Your continued use of the Services after the changes become effective constitutes your acceptance of the revised Terms.

14. Termination

By You: You may cancel your account at any time by following the instructions on the Website.

By Us: We may suspend or terminate your access to the Services at any time, with or without cause or notice.

Effect of Termination: Upon termination, all rights granted to you under these Terms will cease, and you must cease all use of the Services.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms shall be resolved in the courts of Frankfurt am Main, Germany.

16. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and doloc regarding the use of our Services.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

18. Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.
